Thats the approach I take as well, I don't see why a formal state needed to be established for those returning from Europe in the 20 century, I don't see why all people's could have settled without the forceful taking of any land.

Your view is shortsided. The Jews didn't came there and started a war. To make a long story short. The British gave every living soul in the Palestine mandate (legally or illegally there) the same citizenship. So they were all citizens of the same state, a state that was supposed to become the Jewish homeland. The Palestinians, who never had a country in any form, didn't want one (refused their part). The jews took what was left for them.
