John McCain: Voted in 2006 to reauthorize the Patriot Act. Favors closing the detention center for suspected terrorists at Guantanamo Bay, a position at odds with most of the Republican candidates who opposed him for the nomination. Would move the terror suspects to Ft. Leavenworth in Kansas. Sponsored anti-torture legislation called the Detainee Treatment Act of 2005. Voted in 2006 in favor of military tribunals for terror suspects. Voted in February 2008 to authorize the Bush administration's warrantless wiretapping program and provide retroactive immunity to telecommunications companies that cooperated with it.
Hillary Clinton: Has expressed reservations about parts of the Patriot Act but voted to reauthorize it in 2006. Favors closing of Guantanamo. Voted against military tribunals for terror suspects. Has criticized warrantless wiretaps and opposes retroactive immunity for telecoms but, like Barack Obama, was not present when the bill came to a vote in February 2008. Co-sponsored bill to ensure that distribution of homeland security funding is based on risk level and vulnerability of states. Also co-sponsored the Intelligence Reform and Terrorism Prevention Act in 2004, which created a director of national intelligence
Barack Obama: Has criticized aspects of the Patriot Act but voted to reauthorize it in 2006. Calls for closing of Guantanamo. Voted in 2006 against military tribunals for terror suspects. Criticized warrantless wiretapping and opposes retroactive telecom immunity. But like Hillary Clinton, did not vote on the bill when it came up for a vote. Co-sponsored the Detainee Treatment Act of 2005, advocated risk-based funding for homeland security. Co-sponsored the Chemical Security and Safety Act, aimed at increasing chemical plant security. Wants to create a fixed term limit for the director of national intelligence.
