Body orders woman raped by father-in-law to separate from husband

LUCKNOW: A powerful Muslim body in India on Monday ordered a woman allegedly raped by a relative to separate from her husband, but said she was free to remarry if she wished.

The victim, 28-year-old Imrana Ilahi, was allegedly raped by her father-in-law in Muzafarnagar district of northern Uttar Pradesh about two weeks ago. The All India Muslim Personal Law Board, set up in 1972 to protect the rights of Muslim women in the country, said the marriage would have to come to an end.

“According to the Holy Quran, Imrana’s conjugal relationship with her husband stood dissolved since she has been raped by the latter’s blood relative,” the board’s woman member Begum Naseem Iqtedar Ali told reporters here. “Had she been raped by anyone other than a blood relation, she could have stayed with her husband ... but here a sacred relationship had been violated, the consequences of which have to be borne by Imrana and her husband Noor Ilahi,” she said. But Imrana could remarry if she wanted to, she added.

The Muslim body’s rulings are binding on all Muslims in the country. But it was a ruling by a group of local Muslim clerics that the mother of five children marry her rapist and treat her husband as her son that caused an public outcry. The Muslim clerics said the rape had annulled the woman’s marriage to her husband and had ordered that she marry her father-in-law. afp

Last time i checked India is Ruled by Law ; Not Some Mulla giving Verdicts on what Islam Thinks ........ Anybody is Free to say what they would like to say or Give verdicts but the LAW will take it's own Course .......... India is a Secular Country so every Muslim Organisation is Free to Give whatever verdict they damm please But that's not Law .

The woman's father-in-law has been arrested and is in jail. ......... He will have to face the Court of Law ........... and If found Guilty he Could face Life Inprisonment.

Police in the northern Indian state of Uttar Pradesh have arrested a man accused of raping his daughter-in-law.

The arrest follows reports that a Muslim council of community elders had ordered the victim to marry her father-in-law.

But the order was criticised by a top Muslim body which said it was not valid under Sharia (Islamic) law.

It said the council was not authorised to give such a verdict and added that the alleged rapist should be punished.

Senior superintendent of police in the town of Chatarwal, where the incident took place, told The Indian Express newspaper that the alleged rapist was being questioned.

The 28-year-old victim is said to have been raped when she was alone at home.

When the incident came to the notice of the council, it ordered that she marry her father-in-law and change her relationship with her husband to that between a mother and son.

It also ordered her to leave her home and stay away for seven month and 10 days to become "pure".

Women's group

India's National Commission of Women has also asked for a report from the government in the state of Uttar Pradesh, where the incident took place.

"We have requested the government to take action against the guilty and also pay compensation to the victim," NCW president Girija Vyas told the BBC.

A representative of a top Muslim body in India, the All India Muslim Personal Law Board, said the case should be dealt under Islamic law.

"Under the Sharia law, whatever happened with the victim is wrong and if her father-in-law has raped her, he should be sentenced to death," the representative, Zafarab Geelani, said.

So, all boiled down, who trys and sentences this guy? Will the Muslim groups go along with the verdict and punishment or can they cause problems for the Government?

India is Ruled by Constitution ...... and Court will decide his fate ......and NO Court is not Ruled by Some Muslim Organisation.

Dosen't matter if they do are do not ............ everyboy has to abide by the Law , willingly or Unwillingly ...... Secularism means Religion has Nothig to do with the states functioning ............. The Woman and her Husband has been given Police Protection and nobody can force them to do anything against their wishes.
