U.S. Attorney General Michael Mukasey said Thursday that the Constitution's protection against unreasonable searches applies to domestic military operations, repudiating part of a 2001 Justice Department legal memo that asserted broader federal power to combat terrorism.
But Mukasey, under questioning by a Senate Appropriations panel, refused to say whether the still-secret memorandum has been withdrawn or whether it had been applied in any situations in the USA.
The 2001 memo said Fourth Amendment protections, such as the need in most cases to obtain a warrant before a search, have "no application to domestic military operations."
"The Fourth Amendment applies across the board, whether we're in wartime or peacetime," Mukasey told senators.
