In a case that could challenge the doctrine of separation of church and state, the Supreme Court agreed to decide whether an eight-foot cross to honor fallen Soldiers can stand in the Mojave National Preserve in San Bernardino County, Calif. A smaller wooden cross was first erected by the Veterans of Foreign Wars in 1934 and maintained as a war memorial by the National Park Service.

Update on the fate of this Memorial. The case will be heard by the Supreme Court in October.

Congress tried to swap one acre of the National Mojave Preserve for 5 acres on the boundary of the preserve. But the ACLU got the Federal Appeals court to disallow the swap. The ACLU argues the Cross must be destroyed.
