On a legal note

In Europe plaintiffs can be forced to pay legal costs if the judge decides that it is a frivolous lawsuit. This exists in the states but is rarely used, -that needs to change.
Besides even if he were an adult its a frivilous lawsuit. Skiing is a SPORT. In in Sports you must accept the risk that you can get hurt. I have certainly had my share of injuries.

On a sportsman note...

I am a pretty experianced skier, and I can tell you that most collisions are from beginners on advanced or expert trails who stupidly stop, go too slowly, or are otherwise reckless to other skiers. The best way to navigate a difficult trail is as quickly as possible, by sharp fast turns.
