Lawsuit Accuses Company Of Firing Guardsman

The U.S. Department of Justice filed a lawsuit Friday on behalf of a Michigan Army National Guard member serving in Iraq, accusing his Sturgis employer of firing him in violation of a federal law that protects people who must leave civilian jobs to serve in the military.
David Sweatt, who enlisted in the guard in September 2002, said that Americraft Carton Inc., his employer since 2007, violated the Uniformed Services Employment and Reemployment Rights Act of 1994. The suit alleges that the company fired him on April 16 after he volunteered for a mission with the U.S. Border Patrol.
The complaint was filed in U.S. District Court in Grand Rapids.
Sweatt is asking that all references to his being fired be removed from his employment record and that he be given lost wages and benefits with interest. He also asks for damages equal to his lost wages and benefits and for the court to order the Missouri-based company to comply with the law.
