SAN JUAN, Puerto Rico - A military judge yesterday rejected a request to postpone a pretrial hearing for a Guantanamo prisoner after Thursday's Supreme Court decision that detainees at the base in Cuba have constitutional rights.
Attorneys for Canadian detainee Omar Khadr said they wanted more time to study the high court's decision to see how it affects their client. The judge, Col. Patrick Parrish, denied that request, saying the hearing would take place as scheduled Wednesday at the base, said Navy Lt. Cmdr. William Kuebler, Khadr's defense lawyer.
Kuebler said the high court's ruling on the legal standing of Guantanamo detainees could nullify previous rulings by the tribunal as it prepared for Khadr's murder trial. Khadr, 21, is accused of throwing a grenade that killed a U.S. Special Forces soldier during a battle in Afghanistan in 2002.
