Ive already downloaded the Sega Genesis and Nintendo 64. the N64 is only fun if u have a controller with a joystick, but the sega is fun with the keyboard. They pretty much have any game ever made for older console. That excludes mario games.

Or legal if the game is classified abandoneware by the software company. Many software companies put their old games online for free download if they have become classics but no longer in sale; such as games from Team-17, Mindscape (Wings for example) and so on.

However what's the fun of downloading ROMS for your PC when most people have an old SEGA or Nintendo in their closet

Well, if i wasnt so stupid I wouldnt have traded it in to EB games But yeah if you delete them in 24 hrs they arent illegal but i dont really think that its that big of a deal considering most of you have limewire or something comparable to it.

That's what the site says, but that's not how it works in real life if it's a game/trademark that's still active..

Ok, let's begin.

1. This type of "disclaimer" is not legal because it is a unilateral agreement that would take away the copyright owner's right to defend his work against infringement.

2. It cites "code 431.322.12 of the Internet Privacy Act" as a law that protects its piracy. This law does not exist.

3. Yes, it is legal to make an archival copy of software that you already own (provided that it isn't explicitly denied in the EULA), BUT:

"any copy made for archival purposes is either destroyed, or transferred with the original copy, once the original copy is sold, given away, or otherwise transferred." -US Copyright Office

Therefore, you are allowed to make "backup" copies of software that you currrently own, but you can not sell or otherwise distribute your backup unless you're also giving the original file with it.

In other words, that disclaimer is complete hogwash. Those ROMs are very much illegal. Taking legal advice from pirates is like taking medical advice from a drug dealer.
