FORT LAUDERDALE -- A federal judge in Fort Lauderdale has thrown out the conviction and sentence for an Iranian woman accused in a scheme to illegally obtain night vision goggles for Iran.
U.S. District Judge James Cohn found that Shahrazad Mir Gholikhan, 30, relied on a mistaken calculation of her possible sentence when she pleaded guilty in April. That mistake led her to think she would get time served and go home to Iran.
Prosecutors later pointed out the error and said she had to serve more than two years. Judge Cohn agreed at the time.
But the judge decided Thursday to allow Miss Gholikhan to withdraw her guilty plea and go to trial in late July.
The case involved an attempt in 2004 by Iran to obtain thousands of pairs of military night-vision goggles.
